The Importance of Solicitors

Our basic advice is to always consult a lawyer when purchasing new or resale property.  The Spanish legal system is very different from the English system. Your usual English solicitor or  lawyer knows English law, not Spanish law.

Unfortunately, very often people purchasing property in Spain take little or no legal advice and are indeed quite "casual" about the purchase and about the signing of legal documents. They may then find there is no title to the property that it was built without planning permission etc.etc.... Whilst frauds happen, luckily they form a small part of the many thousands of transactions, which take place in Spain every year.

Having instructed a solicitor to handle the purchase, you have the reassurance that all the important aspects will be covered.

You should be aware that there are some very unscrupulous solicitors out there who actually prefer to take your holding deposit and then either ensure that you loose your chosen property due to their slow response or careless inaction, or worse – due to their inexperience in rustic properties, will mislead and misinform the buyer in order to avoid their actually carrying out any conveyancing whatsoever, and therefore retain the original deposit – as a gift from you to them!

Please look for a Spanish solicitor or lawyer who has experience in rustic property, or better still is actually classified as a rustic specialist.  He will conclude his work in a timely fashion, and make very sure that your intended purchase is in perfect condition to buy.
